1. Acceptance of Terms

By accessing or using any product or service operated by Inferent or any of its subsidiaries and affiliates (collectively, "Inferent," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use our services.

These Terms constitute a legally binding agreement between you and Inferent Group S.A. de C.V. If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Definitions

"Services" means any platform, application, website, API, or software product operated by Inferent or its subsidiaries, including but not limited to Inclick, Leuks, Harmony, ATLAS, PulsePolls, Koda, Blue, Mine, Rumbo, NeoFuturo, and Kalia.

"User" or "you" means any individual or entity that accesses or uses the Services.

"Content" means any text, data, images, audio, video, or other material that is submitted to, transmitted through, or displayed via the Services.

"Account" means the registered profile through which you access our Services.

3. Use of Services

Our Services are designed to provide value through technology, intelligence, and human-centered design. You may use our Services only for lawful purposes and in accordance with these Terms.

You agree not to use the Services in any way that violates applicable local, national, or international law or regulation. You are responsible for ensuring that all persons who access our Services through your account are aware of these Terms and comply with them.

  • Impersonating any person or entity, or misrepresenting your affiliation
  • Using our AI-powered features to generate content that is harmful, deceptive, or violates our Acceptable Use Policy
  • Reverse engineering, decompiling, or disassembling any part of our Services

6. Intellectual Property

All intellectual property rights in our Services and their content—including but not limited to software, designs, trademarks, and documentation—belong to Inferent or our licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

You retain ownership of any Content you submit to our Services. By submitting Content, you grant Inferent a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that Content solely as necessary to provide the Services.

7. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.

8. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, INFERENT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content may contain inaccuracies. Do not rely solely on AI outputs for medical, legal, financial, or other professional decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFERENT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Mexican States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Mexico.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on our website and, where appropriate, sending you an email notification. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
